MDL Established in New York for Propecia Sexual Side Effects Lawsuit

Propecia lawsuits filed in federal district courts throughout the country will soon be transferred to U.S. District Judge John Gleeson in the U.S. District Court for the Eastern District of New York for coordinated pre-trial proceedings as part of a multidistrict litigation (MDL). A panel of federal judges ordered the transfer on April 16.

Nine lawsuits pending in six different federal district courts nationwide, but the FDA’s announcement that Merck will update the Propecia warning label to include information on about a link between the drug and long-term sexual dysfunction will likely cause that number to grow.

Plaintiffs in the cases allege that Merck failed to adequately warn them about the risks of serious and long-term sexual side effects, such as erectile dysfunction, loss of libido, and impotence. Prior warnings indicated that any sexual dysfunction typically resolved, but many men have said the sexual effects of the drugs lasted long after the medication is no longer used.
