Parker Waichman representing Rhode Island woman in Fosamax femur fracture lawsuit

Filed July 24th, 2012 Joshua Sophy

A Rhode Island woman believes her taking the osteoporosis drug Fosamax led to her suffering a femur fracture.

The woman is being represented in a lawsuit against the makers of Fosamax by the national law firm of Parker Waichman LLP, which represents other victims of Fosamax injuries. Her lawsuit filed in Superior Court of New Jersey names Merck Sharp & Dohme Corp. and Merck & Co. as Defendants.

The woman says she suffered a subtrochanteric fracture to her right femur bone in June 2010. At the time, she had been taking Fosamax for several years as she was seeking to stem some of the more dangerous symptoms of osteoporosis, namely bone loss. Fosamax carries an ironic side effect in that many people taking the drug believe they’ve suffered similar injuries as the Rhode Island woman.

Rather than strengthening the bone and preventing bone loss – a common condition caused by osteoporosis – Fosamax users believe the drug actually reduces the strength of the femur bone to the point where it can fracture unexpectedly. The femur bone is considered one of the most difficult in the body to break.

In addition to seeking damages incurred by the femur fracture, the Rhode Island woman seeks compensation for “a number of serious consequences from taking Fosamax, including severe mental and physical pain and suffering, permanent injuries, emotional distress, economic loss due to medical expenses and living related expenses due to a new lifestyle.”

The lawsuit accuses the makers of Fosamax of concealing data showing this potential risk, especially when the drug is taken over longer periods of time. Instead, Fosamax and other bisphosphonate drugs were marketed as safe and effective.
