Settlment Reached in Bellwether Fosamax Lawsuit

The estate of Shirley Boles has reached a confidential agreement with Merck & Co. Inc. concerning the amount of damages to be paid by the pharmaceutical manufacturer to the late claimant’s estate.

The Plaintiff’s estate had previously been awarded $8 million by a federal court jury in New York after Boles suffered jawbone death as a result of taking the osteoporosis drug Fosamax, but that award was later overturned.

Merck has faced thousands of bellwether trials filed by Plaintiffs who alleged they developed jawbone ailments after taking Fosamax. The U.S. Food and Drug Administration issued a safety announcement in 2010 informing the public that patients taking the drug had an increased risk of atypical thigh and femur fractures.
